Er is dus geen procedure via het UWV of de rechter nodig. In de overeenkomst staan afspraken over onder andere de einddatum, de ontslagvergoeding, de vrijstelling van werk en de verrekening van openstaande vakantiedagen.<\/p>\n<p>In de praktijk wordt een be\u00ebindigingsovereenkomst vaak vastgelegd in een vaststellingsovereenkomst. Dat is de juridische vorm die het UWV accepteert om te bepalen of u recht heeft op een WW-uitkering. Daarbij moet rekening worden gehouden met de wettelijke of contractuele opzegtermijn. Die termijn geldt ook als u in overleg uit elkaar gaat.<\/p>\n<p>De opzegtermijn bepaalt de periode tussen het moment van ondertekening en de daadwerkelijke einddatum van het dienstverband. De lengte van deze termijn hangt af van uw arbeidsduur of wat er in uw arbeidsovereenkomst of cao staat. Vaak varieert dit van \u00e9\u00e9n tot vier maanden.<\/p>\n<p>Het is belangrijk dat de afgesproken einddatum past binnen deze termijn. Het <a href=\"https:\/\/www.transitievergoedingberekenen.nl\/vaststellingsovereenkomst\/vaststellingsovereenkomst-en-uwv\/\">UWV<\/a> kijkt niet alleen naar het bestaan van de overeenkomst, maar vooral naar de formuleringen in het document. De juiste opzegtermijn<\/h3>\n<\/td>\n<\/tr>\n<tr>\n<td style=\"border: 1px solid #ccc; padding: 10px; vertical-align: text-top;\">In de overeenkomst moet duidelijk blijken dat het initiatief voor de be\u00ebindiging bij de werkgever ligt en dat u daar als werknemer mee akkoord gaat. Staat het anders verwoord, dan kan het UWV dat zien als eigen ontslag, waardoor uw recht op WW vervalt. Zinsdelen als \u201c<em>in onderling overleg besloten te be\u00ebindigen<\/em>\u201d kunnen al tot verwarring leiden.<\/td>\n<td style=\"border: 1px solid #ccc; padding: 10px; vertical-align: text-top;\">Een werknemer die op eigen schuld of nalatigheid wordt ontslagen, komt niet in aanmerking voor een WW-uitkering. In uw be\u00ebindigingsovereenkomst mag daarom geen verwijt aan uw kant worden genoemd.<br \/>\nKies voor neutrale formuleringen, bijvoorbeeld:<em>\u201cDe arbeidsovereenkomst eindigt met <\/em><a href=\"https:\/\/www.transitievergoedingberekenen.nl\/ontslag-met-wederzijds-goedvinden\/\"><em>wederzijds goedvinden<\/em><\/a><em> op initiatief van de werkgever.\u201d<\/em>Zo voorkomt u discussie met het UWV.<\/td>\n<td style=\"border: 1px solid #ccc; padding: 10px; vertical-align: text-top;\">De afgesproken einddatum van uw dienstverband moet overeenkomen met de wettelijke of afgesproken opzegtermijn.
