u en uw werkgever samen besluiten het dienstverband te be\u00ebindigen. Er is dus geen ontslagprocedure via het UWV of de kantonrechter nodig. De gemaakte afspraken worden vastgelegd in een <a href=\"https:\/\/www.transitievergoedingberekenen.nl\/vaststellingsovereenkomst\/\">vaststellingsovereenkomst (VSO)<\/a>. Daarin staan onder meer de einddatum van het dienstverband, de ontslagvergoeding, uw vrijstelling van werk en afspraken over bijvoorbeeld vakantiedagen of een concurrentiebeding.<\/p>\n<p>Hoewel de term \u201cwederzijds goedvinden\u201d suggereert dat beide partijen evenveel invloed hebben, is dat in de praktijk vaak niet zo. Meestal komt het initiatief van de werkgever. Daarom is het belangrijk om te controleren of de overeenkomst voldoet aan de eisen van het UWV, zodat u uw recht op WW behoudt.<\/p>\n<\/div><div class=\"fusion-builder-row fusion-builder-row-inner ontslag met wederzijds goedvinden<\/h2>\n<ul class=\"check\">\n<li><strong>Geen lange ontslagprocedure: <\/strong>u voorkomt een langdurige ontslagprocedure; er is geen tussenkomst van het UWV of de rechter nodig, wat tijd, spanning en onzekerheid bespaart.<\/li>\n<li><strong>Betere voorwaarden: <\/strong>u kunt in overleg betere voorwaarden afspreken, zoals een hogere vergoeding, een latere einddatum, vrijstelling van werk of een positieve referentie.<\/li>\n<li><strong>Recht op WW:<\/strong> u behoudt bij een correcte<br \/>\nvaststellingsovereenkomst uw recht op WW, mits duidelijk is dat het initiatief bij de werkgever ligt en er geen dringende reden is.<\/li>\n<li><strong>U beslist: <\/strong>u bepaalt zelf of u tekent. Pas na uw handtekening is het ontslag definitief, waardoor u eerst advies kunt vragen of de overeenkomst kunt laten aanpassen.<\/li>\n<li><strong>Goede relatie: <\/strong>de relatie met uw werkgever blijft meestal goed, omdat het ontslag in overleg plaatsvindt en niet via een conflict of procedure. Kleine formuleringen kunnen daarbij al het verschil maken.<\/li>\n<li><strong>Geen ontslagbescherming:<\/strong> omdat u zelf instemt met het ontslag, vervalt de formele ontslagbescherming. U kunt dus niet terugvallen op de rechter als de afspraken tegenvallen.<\/li>\n<li><strong>Geen transitievergoeding gegarandeerd:<\/strong> bij ontslag met wederzijds goedvinden is de werkgever niet verplicht een transitievergoeding te betalen. U moet die zelf <a href=\"https:\/\/www.transitievergoedingberekenen.nl\/vaststellingsovereenkomst\/onderhandelen-vaststellingsovereenkomst-vso\/\">onderhandelen of laten opnemen<\/a> in de VSO.<\/li>\n<li><strong>Risico bij ziekte:<\/strong> bent u (gedeeltelijk) ziek? Dan kan tekenen grote gevolgen hebben voor uw inkomen en uw recht op een Ziektewet- of WIA-uitkering. Het <a href=\"https:\/\/www.transitievergoedingberekenen.nl\/vaststellingsovereenkomst\/vaststellingsovereenkomst-en-uwv\/\">UWV<\/a> beoordeelt namelijk niet alleen of u een VSO heeft getekend, maar vooral wat erin staat. Drie voorwaarden zijn daarbij cruciaal:<\/p>\n<div class=\"scrollcontainer\">\n<table style=\"border-collapse: collapse; width: 100%; border: 1px solid #ccc;\">\n<tbody>\n<tr>\n<td style=\"border: 1px solid #ccc; padding: 10px;\">\n<h3>1. Uw werkgever initieert het ontslag<\/h3>\n<\/td>\n<td style=\"border: 1px solid #ccc; padding: 10px;\">\n<h3>2. Er is geen verwijtbaar gedrag<\/h3>\n<\/td>\n<td style=\"border: 1px solid #ccc; padding: 10px;\">\n<h3>3. De juiste opzegtermijn<\/h3>\n<\/td>\n<\/tr>\n<tr>\n<td style=\"border: 1px solid #ccc; padding: 10px; vertical-align: text-top;\">In de overeenkomst moet duidelijk staan dat het voorstel om te stoppen van de werkgever komt en dat u hier slechts mee instemt. Als het lijkt alsof u zelf ontslag neemt, ziet het UWV dat als <em>vrijwillig ontslag<\/em>, en dan vervalt uw recht op WW. Een kleine formulering als \u201cin goed overleg besloten te be\u00ebindigen\u201d kan al twijfel oproepen, dus dit punt verdient altijd controle.<\/td>\n<td style=\"border: 1px solid #ccc; padding: 10px; vertical-align: text-top;\">Het UWV keert geen WW uit als u bent ontslagen wegens verwijtbaar gedrag, zoals diefstal, werkweigering of herhaald disfunctioneren. In de VSO mag daarom geen verwijt aan uw kant staan vermeld. Er moet neutraal worden geformuleerd, bijvoorbeeld:<\/p>\n<p><em>\u201cDe arbeidsovereenkomst wordt met wederzijds goedvinden be\u00ebindigd op initiatief van de werkgever.\u201d<\/em><\/td>\n<td style=\"border: 1px solid #ccc; padding: 10px; vertical-align: text-top;\">De einddatum van uw arbeidsovereenkomst moet overeenkomen met de wettelijke of contractuele opzegtermijn. Wees dan extra voorzichtig. Tijdens ziekte is ontslag met wederzijds goedvinden vrijwel <strong><u>nooit<\/u><\/strong> in uw voordeel. Uw werkgever mag u namelijk niet eenzijdig ontslaan zolang u arbeidsongeschikt bent, dat is wettelijk beschermd. Toch proberen sommige werkgevers via een VSO het dienstverband eerder te be\u00ebindigen.<\/p>\n<p>Als u tijdens ziekte tekent, verliest u in veel gevallen uw recht op loondoorbetaling \u00e9n het recht op een Ziektewet- of WIA-uitkering. Het UWV ziet het tekenen van een VSO dan als <em>vrijwillig meewerken aan ontslag<\/em>, waardoor u wordt geacht zelf te hebben ingestemd met het be\u00ebindigen van uw contract.<\/p>\n<p>Alleen in specifieke situaties, bijvoorbeeld na twee jaar ziekte en met instemming van de bedrijfsarts, kan een be\u00ebindiging met wederzijds goedvinden wel veilig zijn.
