Dat gebeurt aan de hand van concrete bewijzen die worden voorgelegd aan het UWV of een interne toetsingscommissie. Dat kan bijvoorbeeld door cijfers die duiden op teruglopende omzet, structurele kostenproblemen of een noodzakelijke organisatorische wijziging. Het moet gaan om een echte bedrijfseconomische noodzaak, niet om het simpelweg willen vervangen van vaste medewerkers door goedkopere krachten.<\/p>\n<\/div><\/div><\/div><div class=\"fusion-panel panel-default panel-174c1eccfa1c442fa fusion-toggle-has-divider\" style=\"--awb-title-color:var(--awb-color7);--awb-content-color:var(--awb-custom_color_1);\"><div class=\"panel-heading\"><h4 class=\"panel-title toggle\" id=\"toggle_174c1eccfa1c442fa\"><a aria-expanded=\"false\" aria-controls=\"174c1eccfa1c442fa\" role=\"button\" data-toggle=\"collapse\" data-parent=\"#accordion-23018-2\" data-target=\"#174c1eccfa1c442fa\" href=\"#174c1eccfa1c442fa\"><span class=\"fusion-toggle-icon-wrapper\" aria-hidden=\"true\"><i class=\"fa-fusion-box active-icon awb-icon-minus\" aria-hidden=\"true\"><\/i><i class=\"fa-fusion-box inactive-icon awb-icon-plus\" aria-hidden=\"true\"><\/i><\/span><span class=\"fusion-toggle-heading\">De juiste ontslagvolgorde moet zijn toegepast<\/span><\/a><\/h4><\/div><div id=\"174c1eccfa1c442fa\" class=\"panel-collapse collapse \" aria-labelledby=\"toggle_174c1eccfa1c442fa\"><div class=\"panel-body toggle-content fusion-clearfix\">\n<p>Bij een reorganisatie kiest de werkgever niet zelf wie moet vertrekken. De ontslagvolgorde wordt bepaald via het afspiegelingsbeginsel. Daarbij wordt per functiegroep gekeken naar leeftijdscategorie\u00ebn, tijdelijke contracten en uitzendkrachten. Dit zorgt ervoor dat de personeelsopbouw na de reorganisatie zoveel mogelijk gelijk blijft, ook als dat betekent dat ervaren of goed presterende medewerkers boventallig worden.<\/p>\n<\/div><\/div><\/div><div class=\"fusion-panel panel-default panel-a0370c7f411598a0a fusion-toggle-has-divider\" style=\"--awb-title-color:var(--awb-color7);--awb-content-color:var(--awb-custom_color_1);\"><div class=\"panel-heading\"><h4 class=\"panel-title toggle\" id=\"toggle_a0370c7f411598a0a\"><a aria-expanded=\"false\" aria-controls=\"a0370c7f411598a0a\" role=\"button\" data-toggle=\"collapse\" data-parent=\"#accordion-23018-2\" data-target=\"#a0370c7f411598a0a\" href=\"#a0370c7f411598a0a\"><span class=\"fusion-toggle-icon-wrapper\" aria-hidden=\"true\"><i class=\"fa-fusion-box active-icon awb-icon-minus\" aria-hidden=\"true\"><\/i><i class=\"fa-fusion-box inactive-icon awb-icon-plus\" aria-hidden=\"true\"><\/i><\/span><span class=\"fusion-toggle-heading\">De situatie moet naar verwachting niet verbeteren binnen 26 weken<\/span><\/a><\/h4><\/div><div id=\"a0370c7f411598a0a\" class=\"panel-collapse collapse \" aria-labelledby=\"toggle_a0370c7f411598a0a\"><div class=\"panel-body toggle-content fusion-clearfix\">\n<p>Het UWV kijkt bij reorganisatieontslag vooruit in de tijd. De werkgever moet aantonen dat de bedrijfseconomische situatie in totaal 30 weken niet zal verbeteren: 26 weken inhoudelijke vooruitblik, plus ongeveer 4 weken behandeltermijn van het UWV. Alleen wanneer aannemelijk is dat het werk in die periode niet terugkeert, kan ontslag om bedrijfseconomische redenen worden goedgekeurd.<\/p>\n<\/div><\/div><\/div><div class=\"fusion-panel panel-default panel-8a853bccf0b9d1802 fusion-toggle-has-divider\" style=\"--awb-title-color:var(--awb-color7);--awb-content-color:var(--awb-color7);\"><div class=\"panel-heading\"><h4 class=\"panel-title toggle\" id=\"toggle_8a853bccf0b9d1802\"><a aria-expanded=\"false\" aria-controls=\"8a853bccf0b9d1802\" role=\"button\" data-toggle=\"collapse\" data-parent=\"#accordion-23018-2\" data-target=\"#8a853bccf0b9d1802\" href=\"#8a853bccf0b9d1802\"><span class=\"fusion-toggle-icon-wrapper\" aria-hidden=\"true\"><i class=\"fa-fusion-box active-icon awb-icon-minus\" aria-hidden=\"true\"><\/i><i class=\"fa-fusion-box inactive-icon awb-icon-plus\" aria-hidden=\"true\"><\/i><\/span><span class=\"fusion-toggle-heading\">Herplaatsing moet aantoonbaar niet mogelijk zijn<\/span><\/a><\/h4><\/div><div id=\"8a853bccf0b9d1802\" class=\"panel-collapse collapse \" aria-labelledby=\"toggle_8a853bccf0b9d1802\"><div class=\"panel-body toggle-content fusion-clearfix\">\n<p>Voordat ontslag kan plaatsvinden, moet worden onderzocht of u binnen een redelijke termijn een andere passende functie kunt krijgen. Dit geldt ook voor functies in andere afdelingen of vestigingen, eventueel met ondersteuning zoals scholing. Pas wanneer herplaatsing echt niet haalbaar blijkt, mag de werkgever doorgaan met ontslag.<\/p>\n<\/div><\/div><\/div><div class=\"fusion-panel panel-default panel-91c9b53d24d7f4ba7 fusion-toggle-has-divider\" style=\"--awb-title-color:var(--awb-color7);--awb-content-color:var(--awb-color7);\"><div class=\"panel-heading\"><h4 class=\"panel-title toggle\" id=\"toggle_91c9b53d24d7f4ba7\"><a aria-expanded=\"false\" aria-controls=\"91c9b53d24d7f4ba7\" role=\"button\" data-toggle=\"collapse\" data-parent=\"#accordion-23018-2\" data-target=\"#91c9b53d24d7f4ba7\" href=\"#91c9b53d24d7f4ba7\"><span class=\"fusion-toggle-icon-wrapper\" aria-hidden=\"true\"><i class=\"fa-fusion-box active-icon awb-icon-minus\" aria-hidden=\"true\"><\/i><i class=\"fa-fusion-box inactive-icon awb-icon-plus\" aria-hidden=\"true\"><\/i><\/span><span class=\"fusion-toggle-heading\">De ondernemingsraad moet worden geraadpleegd op basis van artikel 25 en 35b WOR<\/span><\/a><\/h4><\/div><div id=\"91c9b53d24d7f4ba7\" class=\"panel-collapse collapse \" aria-labelledby=\"toggle_91c9b53d24d7f4ba7\"><div class=\"panel-body toggle-content fusion-clearfix\">\n<p>Bij een reorganisatie moet de werkgever de ondernemingsraad betrekken voordat er besluiten worden genomen die gevolgen hebben voor arbeidsplaatsen of de organisatie. Artikel 25 WOR bepaalt dat de OR adviesrecht heeft bij belangrijke bedrijfsbeslissingen, zoals het laten vervallen van functies of het wijzigen van de organisatiestructuur.<\/p>\n<p>Daarnaast verplicht artikel 35b WOR de werkgever om ook bij ingrijpende personele maatregelen tijdig alle relevante informatie te verstrekken, zodat de OR zijn rol goed kan vervullen. Als er geen OR is, moet de werkgever de personeelsvertegenwoordiging (PVT) of de personeelsvergadering (PV) raadplegen, afhankelijk van de omvang van het bedrijf.<\/p>\n<\/div><\/div><\/div><\/div><\/div><blockquote>\n<h2>Controleer het volgende na ontslag bij reorganisatie<\/h2>\n<strong><em>Wanneer uw ontslag via het UWV of een interne ontslagcommissie is verlopen, is het belangrijk om na afloop enkele cruciale punten te controleren. Gebeurt dat later, dan is de opzegging ongeldig. U kunt in dat geval de kantonrechter verzoeken het ontslag te vernietigen. Dit moet wel binnen twee maanden na uw laatste werkdag gebeuren, want daarna vervalt deze mogelijkheid.<\/p>\n<\/div><\/div><\/div><div class=\"fusion-panel panel-default panel-25ad2656832395c08 fusion-toggle-has-divider\" style=\"--awb-title-color:var(--awb-color7);--awb-content-color:var(--awb-color7);\"><div class=\"panel-heading\"><h4 class=\"panel-title toggle\" id=\"toggle_25ad2656832395c08\"><a aria-expanded=\"false\" aria-controls=\"25ad2656832395c08\" role=\"button\" data-toggle=\"collapse\" data-parent=\"#accordion-23018-3\" data-target=\"#25ad2656832395c08\" href=\"#25ad2656832395c08\"><span class=\"fusion-toggle-icon-wrapper\" aria-hidden=\"true\"><i class=\"fa-fusion-box active-icon awb-icon-minus\" aria-hidden=\"true\"><\/i><i class=\"fa-fusion-box inactive-icon awb-icon-plus\" aria-hidden=\"true\"><\/i><\/span><span class=\"fusion-toggle-heading\">Invulling van uw functie tot 26 weken na het ontslag<\/span><\/a><\/h4><\/div><div id=\"25ad2656832395c08\" class=\"panel-collapse collapse \" aria-labelledby=\"toggle_25ad2656832395c08\"><div class=\"panel-body toggle-content fusion-clearfix\">\n<p>Bij de wederindiensttredingsvoorwaarde belooft de werkgever dat uw functie 26 weken lang niet opnieuw wordt ingevuld. Als uw oude baan binnen die periode weer beschikbaar komt of door iemand anders wordt vervuld, kunt u in principe aanspraak maken op terugkeer. Ontdekt u dat de functie opnieuw is uitgezet of al is ingevuld, dan kunt u de kantonrechter verzoeken het ontslag te vernietigen. Welke procedure wordt gevolgd, hangt af van de situatie binnen het bedrijf en de afspraken die zijn gemaakt. In de praktijk zijn er drie mogelijkheden.<\/p>\n<div class=\"scrollcontainer\">\n<table style=\"border-collapse: collapse; width: 100%; border: 1px solid #ccc;\">\n<tbody>\n<tr>\n<td style=\"border: 1px solid #ccc; padding: 10px;\">\n<h3>1. Ontslagprocedure via de kantonrechter<\/h3>\n<\/td>\n<\/tr>\n<tr>\n<td style=\"border: 1px solid #ccc; padding: 10px; vertical-align: text-top;\">Bij een reorganisatie kiest een werkgever vaak voor <a href=\"https:\/\/www.transitievergoedingberekenen.nl\/ontslag-met-wederzijds-goedvinden\/\">ontslag met wederzijds goedvinden<\/a>. U ontvangt dan een vaststellingsovereenkomst (VSO) met daarin alle voorwaarden van uw vertrek. U hoeft deze route niet te accepteren; het is een voorstel dat u mag laten beoordelen en waarover u kunt onderhandelen.<\/p>\n<p><strong>Belangrijk om te weten<\/strong><\/p>\n<ul>\n<li>U bent niet verplicht te tekenen<\/li>\n<li>Een VSO-check is belangrijk om uw WW-rechten veilig te stellen<\/li>\n<li>U kunt onderhandelen over de vergoeding, einddatum en vrijstelling van werk is mogelijk<\/li>\n<\/ul>\n<\/td>\n<td style=\"border: 1px solid #ccc; padding: 10px; vertical-align: text-top;\">Wanneer u en uw werkgever er samen niet uitkomen, kan de werkgever ontslag aanvragen bij het UWV. In sommige sectoren geldt in plaats daarvan een ontslagcommissie die in de cao is aangewezen. Beide instanties beoordelen of uw ontslag wegens reorganisatie is toegestaan en of de wettelijke regels correct zijn gevolgd.<\/p>\n<p><strong>Belangrijk om te weten<\/strong><\/p>\n<ul>\n<li>De werkgever moet uitgebreid aantonen waarom uw functie vervalt en waarom herplaatsing niet mogelijk is<\/li>\n<li>UWV of de ontslagcommissie toetst aan strikte criteria en beoordeelt de volledige onderbouwing<\/li>\n<li>Wordt het ontslag goedgekeurd, dan behoudt u in principe uw recht op een WW-uitkering<\/li>\n<\/ul>\n<\/td>\n<td style=\"border: 1px solid #ccc; padding: 10px; vertical-align: text-top;\">In uitzonderlijke situaties kan de werkgever de kantonrechter verzoeken om het dienstverband te be\u00ebindigen. Bent u het niet eens met het voorgenomen ontslag, dan kunt u binnen twee weken een gemotiveerde reactie indienen. Het gaat hierbij om situaties waarin een aanzienlijk deel van het personeel boventallig wordt verklaard, bijvoorbeeld door een sterke krimp van het bedrijf of een ingrijpende herstructurering.<\/p>\n<p>Bij een collectief ontslag gelden aanvullende verplichtingen voor de werkgever, zoals het melden van het voorgenomen ontslag bij vakbonden en het UWV. Ook het verliezen van een deel van uw contracturen kan recht geven op een gedeeltelijke transitievergoeding.<\/p>\n<p>De hoogte van de vergoeding hangt af van uw bruto maandsalaris en de duur van uw dienstverband. De opbouw is voor iedereen gelijk: \u00e9\u00e9n derde maandsalaris per dienstjaar. In 2025 bedraagt de transitievergoeding maximaal \u20ac 98.000 bruto, of \u00e9\u00e9n bruto jaarsalaris wanneer dat hoger is.<\/p>\n<p>Ook bij reorganisatie vormt deze wettelijke vergoeding het minimum. Het UWV kijkt hierbij vooral naar de wijze waarop uw dienstverband is be\u00ebindigd en of uw werkgever de reden voor ontslag correct heeft vastgelegd. Een fout in uw vaststellingsovereenkomst kan direct gevolgen hebben voor uw WW-recht. Al vroeg in mijn loopbaan zag ik hoe vaak werknemers onder druk worden gezet om snel een vaststellingsovereenkomst te tekenen, terwijl ze niet precies weten welke rechten ze hebben.
