U hoeft niet meer te werken en uw werkgever hoeft vanaf dat moment geen loon meer te betalen. Dit mag alleen in uitzonderlijke situaties, bijvoorbeeld bij een ernstige misstap.<\/p>\n<p>De wet stelt hier strenge eisen aan. Een werkgever mag u alleen op staande voet ontslaan als er sprake is van een dringende reden, zoals diefstal, fraude of ernstig wangedrag. Bovendien moet het ontslag onmiddellijk worden gegeven en moet de reden direct en duidelijk aan u worden meegedeeld.<\/p>\n<p>Bij ontslag op staande voet vindt geen voorafgaande toetsing plaats door het UWV of de kantonrechter. Het gaat om gedrag waardoor het vertrouwen direct en onherstelbaar is geschonden. In dat geval mag uw werkgever de arbeidsovereenkomst per direct be\u00ebindigen, zonder opzegtermijn. Er zijn 3 wettelijke eisen waaraan het ontslag op staande voet moet voldoen:<\/p>\n<ol>\n<li><strong>Er is een dringende reden<\/strong><\/li>\n<li><strong>Het ontslag is onverwijld gegeven<\/strong>: er mag geen onnodige tijd zitten tussen de gebeurtenis en het ontslag.<\/li>\n<li><strong>De dringende reden is duidelijk meegedeeld en bewijsbaar<\/strong>: uw werkgever moet kunnen aantonen wat er is gebeurd en waarom dit ontslag rechtvaardigt.<\/li>\n<\/ol>\n<p>Wordt aan \u00e9\u00e9n van deze voorwaarden niet voldaan, dan is het ontslag op staande voet juridisch aanvechtbaar. De wet noemt geen vaste lijst, maar in de praktijk gaat het vaak om situaties zoals:<\/p>\n<p><span style=\"letter-spacing: 0.136px; background-color: rgba(0, 0, 0, 0);\">Diefstal, verduistering of fraude (bijvoorbeeld geld, goederen of gegevens van de werkgever)<\/span><\/p>\n<ul>\n<li>Geweld, bedreiging of ernstige intimidatie richting collega\u2019s, leidinggevenden of klanten<\/li>\n<li>Ernstige belediging of discriminatie<\/li>\n<li>Werkweigering zonder geldige reden, vooral na herhaaldelijke waarschuwingen<\/li>\n<li>Drank- of drugsgebruik tijdens werktijd, zeker bij functies met veiligheidsrisico\u2019s<\/li>\n<li>Het overtreden van veiligheidsvoorschriften, met gevaar voor anderen<\/li>\n<li>Lekken of misbruiken van vertrouwelijke informatie<\/li>\n<li>Valse ziekmelding of ander bedrog richting de werkgever<\/li>\n<li>Herhaald ernstig plichtsverzuim, ondanks eerdere waarschuwingen<\/li>\n<\/ul>\n<p>Of sprake is van een geldige dringende reden hangt altijd af van de omstandigheden van het geval, zoals uw functie, de ernst van het gedrag en uw arbeidsverleden. Het dienstverband eindigt onmiddellijk, waardoor u per direct geen salaris meer ontvangt. Daarnaast krijgt u meestal geen positieve referentie, wat het lastiger kan maken om een nieuwe baan te vinden. De wet gaat er dan vanuit dat het ontslag het gevolg is van ernstig verwijtbaar handelen van de werknemer.<\/p>\n<p>Rechters maken hier soms een uitzondering op als er sprake is van zwaarwegende persoonlijke omstandigheden. Dat betekent dat wordt aangenomen dat u zelf verantwoordelijk bent voor het verlies van uw baan. In dat geval vervalt het recht op een WW-uitkering volledig.<\/p>\n<p>Als u geen WW krijgt, kunt u mogelijk een beroep doen op de bijstandsuitkering via uw gemeente. Daarbij geldt wel een strenge vermogenstoets. Dit wordt ook wel de gefixeerde schadevergoeding genoemd. Kort geding aanspannen bij de kantonrechter<\/h2>\n<p>Als bezwaar bij uw werkgever geen oplossing oplevert, kunt u een kort geding bij de kantonrechter starten. Dit is een snelle juridische procedure waarin de rechter een voorlopig oordeel geeft over het ontslag op staande voet.<\/p>\n<p>In een kort geding kan de rechter bijvoorbeeld bepalen dat het ontslag voorlopig geen stand houdt en dat de werkgever het loon moet doorbetalen, of dat partijen opnieuw met elkaar in gesprek moeten. Deze route wordt vooral gekozen wanneer de financi\u00eble gevolgen direct zwaar wegen en snelle duidelijkheid nodig is.<\/p>\n<p><strong>Let op:<\/strong> u moet een kort geding binnen 2 maanden na de ontslagdatum aanspannen.<\/p>\n<h3>Wat is de mogelijke uitkomst hiervan?<\/h3>\n<p>Oordeelt de kantonrechter dat niet aan de wettelijke eisen voor ontslag op staande voet is voldaan, bijvoorbeeld omdat er geen dringende reden was of het ontslag niet direct is gegeven, dan kan het ontslag <a href=\"https:\/\/www.transitievergoedingberekenen.nl\/onterecht-gegeven-ontslag-op-staande-voet\/\">ongeldig<\/a> worden verklaard. In dat geval wordt juridisch gedaan alsof het ontslag nooit heeft plaatsgevonden.<\/p>\n<p>In een kort geding kan bovendien blijken dat niet u, maar de werkgever verwijtbaar heeft gehandeld. De rechter kan dan beslissen dat het dienstverband moet worden hersteld of dat u recht heeft op een billijke vergoeding. In hoger beroep gaan<\/h2>\n<p>Bent u het niet eens met de uitspraak van de kantonrechter, dan is het in sommige gevallen mogelijk om in hoger beroep te gaan bij het gerechtshof. Dit kan alleen bij zaken waarbij het financi\u00eble belang hoger is dan \u20ac 1.750.<\/p>\n<p>In hoger beroep wordt de zaak opnieuw beoordeeld. Het gerechtshof kijkt dan of de kantonrechter het recht juist heeft toegepast en of de beslissing in stand kan blijven.
