Dit kan bijvoorbeeld gaan om:<\/p>\n<ul>\n<li>aanhoudende meningsverschillen;<\/li>\n<li>spanningen over functioneren;<\/li>\n<li>een gebrek aan vertrouwen;<\/li>\n<li>problemen in de communicatie.<\/li>\n<\/ul>\n<p>Het gaat niet om een eenmalige discussie, maar om een situatie waarin het conflict blijft voortduren en het werk daaronder lijdt. Juridisch wordt vaak gesproken van een verstoorde arbeidsrelatie of verstoorde arbeidsverhouding. Daarvan is pas sprake als herstel redelijkerwijs niet meer te verwachten is. Werkgevers moeten dit kunnen onderbouwen, bijvoorbeeld met gespreksverslagen, waarschuwingen of pogingen om het conflict op te lossen.<\/p>\n<\/div>\n<\/div><\/div><\/div><div Uw werkgever mag u niet zomaar ontslaan omdat de relatie is verslechterd. Ontslag is pas mogelijk als sprake is van een ernstig en duurzaam verstoorde arbeidsrelatie, waarbij aannemelijk is dat herstel niet meer mogelijk is. Daarbij wordt onder meer verwacht dat de werkgever informatie aanlevert over:<\/p>\n<ul>\n<li>de aard en achtergrond van het arbeidsconflict;<\/li>\n<li>de stappen die zijn gezet om de relatie te herstellen;<\/li>\n<li>schriftelijke vastlegging van communicatie, zoals gespreksverslagen;<\/li>\n<li>eventuele inzet van derden, zoals een mediator of arbodienst;<\/li>\n<li>uw persoonlijke en arbeidsrechtelijke situatie;<\/li>\n<li>de organisatie van de werkgever;<\/li>\n<li>onderzoek naar herplaatsing;<\/li>\n<\/ul>\n<p>interne regels of beleidsafspraken.<\/p>\n<\/div><\/div><\/div><\/div><\/div><div class=\"fusion-text fusion-text-20\"><p>Is onvoldoende geprobeerd om het probleem op te lossen, dan kan het ontbindingsverzoek worden afgewezen. Een verstoorde arbeidsrelatie hoeft uw WW-recht niet in de weg te staan, maar er zijn wel duidelijke voorwaarden.<\/p>\n<p>Voor het behoud van WW is onder meer van belang dat:<\/p>\n<ul>\n<li>het initiatief voor het ontslag bij de werkgever ligt;<\/li>\n<li>u geen ernstig verwijt kan worden gemaakt van het ontstaan of voortduren van het conflict;<\/li>\n<li>de opzegtermijn correct wordt toegepast;<\/li>\n<li>u beschikbaar blijft voor nieuw werk na het einde van het dienstverband.<\/li>\n<\/ul>\n<p>Bij ontslag via de kantonrechter beoordeelt het <a href=\"https:\/\/www.transitievergoedingberekenen.nl\/ontslag-via-het-uwv\/\">UWV<\/a> meestal aan de hand van de uitspraak of aan deze voorwaarden is voldaan. Bij ontslag met wederzijds goedvinden wordt gekeken naar de afspraken die zijn vastgelegd.
