Dit ontslagverbod is bedoeld om werknemers tijdens ziekte te beschermen.<\/p>\n<p>Toch komt het regelmatig voor dat werkgevers tijdens een re-integratietraject het gesprek aangaan over een mogelijke be\u00ebindiging van het dienstverband. Dat gebeurt bijvoorbeeld via een <a href=\"https:\/\/www.transitievergoedingberekenen.nl\/vaststellingsovereenkomst\/\">vaststellingsovereenkomst (VSO)<\/a>. Werkgever en werknemer hebben in deze periode allebei wettelijke re-integratieverplichtingen.<\/p>\n<p>Tijdens eerste spoor ontstaat soms spanning tussen werkgever en werknemer. Bijvoorbeeld wanneer discussie ontstaat over uw belastbaarheid, passend werk of de voortgang van de re-integratie. tijdens re-integratie spoor 2<\/h2>\n<p>Tijdens het tweede spoor van uw re-integratie onderzoekt uw werkgever of u passend werk kunt verrichten bij een andere werkgever. Een tweede spoortraject wordt meestal gestart wanneer terugkeer binnen uw eigen organisatie niet meer haalbaar lijkt.<\/p>\n<p>Juist in deze fase komt ontslag mogelijk ter sprake. Werkgevers sturen tijdens tweede spoor namelijk vaker aan op een vaststellingsovereenkomst, bijvoorbeeld omdat duidelijk wordt dat terugkeer in uw eigen functie niet meer mogelijk is. Tijdens een re-integratietraject mag uw werkgever een vaststellingsovereenkomst (VSO) voorstellen. Dat gebeurt zowel tijdens eerste spoor als tijdens tweede spoor, bijvoorbeeld wanneer terugkeer naar werk onzeker is of wanneer werkgever en werknemer samen duidelijke afspraken willen maken over de toekomst.<\/p>\n<p>Een VSO hoeft niet per definitie nadelig te zijn. In sommige situaties kan een be\u00ebindiging met wederzijds goedvinden juist zorgen voor rust, duidelijkheid en <a href=\"https:\/\/www.transitievergoedingberekenen.nl\/vaststellingsovereenkomst\/ontslagvergoeding-bij-vaststellingsovereenkomst\/\">gunstige financi\u00eble afspraken<\/a>. Wel is het belangrijk dat de overeenkomst juridisch correct wordt opgesteld, zeker wanneer u nog arbeidsongeschikt bent.<\/p>\n<p>Onjuiste afspraken kunnen namelijk gevolgen hebben voor uw loon of <a href=\"https:\/\/www.transitievergoedingberekenen.nl\/vaststellingsovereenkomst\/vso-en-ww-uitkering\/\">WW-recht<\/a>.
