Er moet aan een aantal wettelijke voorwaarden worden voldaan voordat een werkgever u hieraan kan houden. Zo moet het relatiebeding:<\/p>\n<ul>\n<li>schriftelijk zijn vastgelegd in uw arbeidsovereenkomst;<\/li>\n<li>zijn overeengekomen met een meerderjarige werknemer (18+);<\/li>\n<li>in principe onderdeel zijn van een arbeidsovereenkomst voor onbepaalde tijd;<\/li>\n<li>bij een tijdelijk contract duidelijk en concreet worden gemotiveerd.<\/li>\n<\/ul>\n<p>Daarnaast mag een relatiebeding u niet onredelijk beperken in uw mogelijkheden om ander werk te vinden. Dat kan bijvoorbeeld het geval zijn wanneer:<\/p>\n<ul>\n<li>uw functie ingrijpend verandert, waardoor het relatiebeding zwaarder op u is gaan drukken;<\/li>\n<li>het beding u onredelijk beperkt in het vinden van ander werk;<\/li>\n<li>uw werkgever geen zwaarwegend belang meer heeft bij het relatiebeding;<\/li>\n<li>een rechter het relatiebeding geheel of gedeeltelijk vernietigt;<\/li>\n<li>bij een tijdelijk contract geen geldige motivering is opgenomen;<\/li>\n<li>of de afgesproken duur van het relatiebeding is verstreken.<\/li>\n<\/ul>\n<p>Daarnaast komt het regelmatig voor dat tijdens een ontslagregeling afspraken worden gemaakt over het laten vervallen of beperken van een relatiebeding. In sommige situaties blijft het relatiebeding volledig van kracht, maar er zijn ook gevallen waarin het beding kan worden beperkt of vervallen.<\/p>\n<p>Vooral bij <a href=\"https:\/\/www.transitievergoedingberekenen.nl\/vaststellingsovereenkomst\/ontslag-met-wederzijds-goedvinden\/\">ontslag met wederzijds goedvinden<\/a>, bijvoorbeeld via een vaststellingsovereenkomst, wordt een relatiebeding regelmatig onderdeel van de onderhandeling.
