Q: Will I receive unemployment benefit if the instant dismissal is found to be justified?

No. If the instant dismissal is found to be justified, the UWV considers you to be culpably unemployed. In that case, you are not entitled to WW benefits. The UWV then assumes that you lost your job due to your own actions. If the dismissal was later annulled or converted into another termination, for example through a settlement agreement, the assessment may be different. It depends on the final circumstances and agreements.

Q: When can I resign myself?

Instant dismissal yourself is only allowed if your employer commits serious misconduct and you cannot reasonably be expected to continue working. These are exceptional situations, such as: structural failure to pay wages; serious threat, assault or harassment by the employer; deliberately creating an unsafe work situation; coercing illegal acts. As with summary dismissal by the employer, strict requirements also apply to you. The reason must be urgent, you must act immediately and you must communicate the reason immediately and clearly to your employer. If you resign immediately yourself without these conditions being met, you run the risk of the UWV classifying you as culpably unemployed. In that case, you are usually not entitled to WW benefits.

Q: Can I apply for a new job immediately after instant dismissal?

Yes, you may apply immediately after instant dismissal. There is no waiting period. In fact, actively applying for a job may actually be wise to limit your loss of income. You are not obliged to mention in job applications that you have been summarily dismissed unless explicitly asked.
